Public offer for distance selling of goods

This document is a public offer by Sole proprietor Kseniia Pavlovna Guseva, INN 770378608818, OGRNIP 326774600485190, address: 37/5–230A Leningradsky Prospekt, Moscow, 125167, Russia (the "Seller") and contains all material terms of a retail distance-selling agreement.

The Seller's website is at https://arieteleone.ru (the "Site"). The Buyer is a capable natural person purchasing goods solely for personal, family, household or other needs unrelated to business activity (the "Buyer").

By placing an order on the Site, the Buyer confirms that they have read and fully accept the terms of this offer.

The Seller may amend this offer. The new version takes effect upon publication on the Site and does not alter contracts already concluded. An order is governed by the version in force when the contract was formed.

The Seller undertakes to transfer swimwear, lingerie and related goods (the "Goods") to the Buyer, and the Buyer undertakes to accept and pay for them under this offer.

Each product page shows the name, main characteristics, composition, size information, price, images, manufacturer details and other mandatory information. Minor shade differences between the screen image and the Goods are not a defect.

Goods are offered for sale from stock. No production lead time is undertaken towards the Buyer; times for handing the order to a carrier are set out in section 5.

The Buyer places the order on the Site, providing first name, last name, phone, email, delivery address or pickup point and, if needed, a comment. The Buyer is responsible for accurate details and must promptly report changes.

An order is accepted once confirmed by the Seller. After receiving the order, the Seller sends confirmation with the order number and material terms. The Seller may contact the Buyer only to clarify details needed to fulfil the order.

Goods are reserved for the Buyer for 24 hours from the moment the Seller sends confirmation and a payment link or details. If payment is not received in time, the reservation is released and the Buyer is notified.

The Buyer may cancel the order at any time before it is handed to the carrier by emailing ariete.leone@yandex.ru or calling +7 (906) 027-21-66.

Prices are stated in Russian roubles and include applicable taxes under the Seller's tax regime (Simplified tax regime, VAT not charged). Delivery cost is shown separately before order confirmation.

Payment is made online by bank card or via the Faster Payments System using YooKassa. Card details are entered on the payment provider's secure page and are never transmitted to the Seller.

A fiscal receipt is issued via a cloud cash register connected to YooKassa; the order composition is sent to the register automatically. The electronic receipt is sent to the Buyer's email or phone as required by law.

The Buyer's payment obligation is fulfilled when the payment service confirms a successful payment or when funds reach the Seller under an agreed method.

Available delivery methods: Moscow courier, CDEK, Boxberry and Russian Post, depending on availability for the Buyer's address on the order date. Exact method, time and cost are shown before confirmation.

For Goods costing from 25,000 roubles, delivery is at the Seller's expense. Unless stated otherwise at checkout, the threshold is based on the amount actually paid for the Goods after discounts and promo codes.

The order is handed to the carrier no later than the next working day after payment, unless another time is expressly agreed in the order confirmation.

Risk of accidental loss or damage passes to the Buyer upon actual handover to the Buyer or a named recipient.

On receipt the Buyer checks packaging integrity, quantity and outward condition. Failure to check on receipt does not deprive the Buyer of statutory rights.

The Buyer may refuse the Goods at any time before handover and, after handover, within 7 days. If written information on return procedure and time limits was not provided on delivery, the refusal period is 3 months. Limits on the list of non-food goods of proper quality that cannot be exchanged do not remove the right to refuse Goods bought at a distance.

For a return of Goods of proper quality, appearance and consumer properties must be preserved: no signs of wear, washing, soiling, odours, stretching or damage; sewn-in labels, seals and hygiene protectors must remain if they were present.

The Buyer agrees that Goods made to their individual parameters have individually determined properties and cannot be returned (under Art. 26.1(4) of the Consumer Rights Protection Act). This applies only where such custom Goods are actually ordered.

Goods may be handed in at 37/5–230A Leningradsky Prospekt, Moscow, 125167, Russia or sent by an agreed carrier. The Seller provides a realistically available return method and does not require a personal visit to a remote store. The Buyer bears return shipping for Goods of proper quality; only statutory Seller costs of delivering returned Goods from the Buyer may be deducted from the refund.

Quality checks and, where the cause of a defect is disputed, an expert examination are paid for by the Seller. Return costs for defective Goods are borne by the Seller.

Claims for defective Goods, including wrong model or size, may be made during the warranty period or, if none is set, within 2 years of handover subject to law. The Buyer may choose replacement, price reduction, defect remedy, reimbursement of remedy costs, or contract termination with a refund.

Refunds on refusal of Goods of proper quality and on claims for defective Goods are made within 10 days of the claim. Replacement of defective Goods follows statutory times: usually 7 days, up to 20 days with an extra quality check, or up to 1 month if the needed Goods are unavailable.

An electronic gift certificate is valid for 12 months from purchase and may be used in parts. It is not Goods and cannot be exchanged for cash, except where the Buyer (holder) requests return of the advance before the certificate is redeemed.

The Site may offer percentage or fixed promo codes. Terms, validity, minimum order, eligible Goods and stacking with other discounts are stated before checkout. On return, the Buyer receives the amount actually paid for the returned Goods after the discount applied.

The Seller is liable to the Buyer for proper performance of the contract, including where carriers and payment or cash-register services are engaged, unless law expressly provides otherwise. The Buyer bears the risk of inaccurate contact details.

Matters not covered by this offer are governed by the laws of the Russian Federation. These terms do not limit mandatory consumer rights, including the right to choose statutory venue for disputes.

Personal data is processed under the Privacy Policy published on the Site. Where consent is required, it is given separately from accepting this offer; marketing consent is requested via a separate optional checkbox.
